Legal Notice. Intellectual property

DIRNA, S.A. (hereinafter DIRNA) is the holder of all exploitation rights of the intellectual property of the site www.dirna.com, the design, the details, lists, charts, outlines, application manuals, support material, identification symbols, passwords, names, security symbols and any other element which could be part of the aforementioned site, with exception of those code pieces recognized with license open-source/freeware/gnu.

In case that any element of the site were not of the exclusive property of DIRNA, that circumstance would be appropiately specified in the Intellectual Property Annex.

Due to this circumstance, DIRNA, has the wider authority to amend and reproduce the site, and to transfer to third parties his rights partcially, or in a total way. It is absolutely forbidden any act of reproduction, delivery, public communication and / or transformation of any element of any element of the site developed by or property of, DIRNA.

It will be understood as an act of reproduction, delivery, public communication and transformation (as says the Order in Council 1/1996 dated on 12th of april about intellectual property law, the Board 91/250/CEE dated on 14th of may about legal protection for computer programs, the Board 96/6/CE dated on 11th of march about legal protection of the data bases and the Board 93/98/CE dated on 29th of october about harmonisation of the protection period of the author right and several related rights) as follows:
?REPRODUCTION: establishment of the work in a way that permits its communication and the obtaintion of copies of all or part of that work.
?DELIVERY: leaving the original or copies of the work available for the public by selling them, renting, sharing, or any other way.
?PUBLIC COMMUNICATION: any act which by one or more persons can have access to the work without having previous copies delivered to each person.
?TRANSFORMATION: translation, accomodation and any other amend in its form that could be considered a different work. Any act against the aforementioned will constitute a breach of the aforementioned regulation which will derive in the consistent civil liability, however, that act could constitute also a crime specified in the articles 270 and next of the spanish criminal code, with punishments up to four years of prission. The non licensed access to the registered user´s zone, also constitutes a breach of the aforementioned regulations being the consequences for that access, the same as the ones mentioned at the prior parragraph.

RESPONSIBILITY EXEMPTION CLAUSE
The present site supplies access to information made by DIRNA, S.A. (hereinafter DIRNA) offering a totally free service to the general public and to the registered users of the site. However DIRNA doesn't assume any responsibility concerning to the material included in these pages. Although DIRNA has made a big effort to draw up this site, and although DIRNA´s site will continue updating and getting better, thae material included in it can't offer necessarily an exhaustive, complete, exact or updated information. DIRNA doesn´t guarabtee that the totality of the documents available on line, exactly reproduce the original texts. Therefore, DIRNA tries to reduce at the minimum the possible problems caused by technical errors, however we can't guarantee that our service wont get suspended or affected by that problems. DIRNA doesn't assume any liability according to that problems.

APPLICABLE JURISDICTION AND LEGISLATION
The site´s use implies that all litigation, nonagreement, issue or reclamation running with the use of the site, will be definitively solved by the Madrid Arbitration Cort of the Oficial Chamber of Commerce and Industry, to which is entrusted the arbitration administration and the arbitrator designation in order with its Regulation and Statutes. The parties bind themselves to obey the dictated arbitral award. In case that the parties don´t reach an agreement with the arbitration, or that agreement were anull, both parties will stand to the Alcalá de Henares - Madrid Courts renouncing to his proper law if it were another one. The Spanish legislation will be applied to disputes that could raise between both parties as a result of the site use.
